The present book is a sequel to Ephraim Chamiel's two previous works The Middle Way and The Dual Truth-studies dedicated to the "middle" trend in modern Jewish thought, that is, those positions that sought to combine tradition and modernity, and offered a variety of approaches for contending with the tension between science and revelation and between reason and religion. The present book explores contemporary Jewish thinkers who have adopted one of these integrated approaches-namely the dialectical approach. Some of these (...) thinkers maintain that the aforementioned tension-the rift within human consciousness between intellect and emotion, mind and heart-can be mended. Others, however, think that the dialectic between the two poles of this tension is inherently irresolvable, a view reminiscent of the medieval "dual truth" approach. Some thinkers are unclear on this point, and those who study them debate whether or not they successfully resolved the tension and offered a means of reconciliation. The author also offers his views on these debates. This book explores the dialectical approaches of Rav Kook, Rav Soloveitchik, Rabbi Abraham Joshua Heschel, Samuel Hugo Bergman, Leo Strauss, Ernst Simon, Emil Fackenheim, Rabbi Mordechai Breuer, his uncle Isaac Breuer, Tamar Ross, Rabbi Shagar, Moshe Meir, Micah Goodman and Elchanan Shilo. It also discusses the interpretations of these thinkers offered by scholars such as Michael Rosenak, Avinoam Rosenak, Eliezer Schweid, Aviezer Ravitzky, Avi Sagi, Binyamin Ish-Shalom, Ehud Luz, Dov Schwartz, Rabbi Yuval Cherlow, Lawrence Kaplan, and Haim Rechnitzer. The author questions some of these approaches and offers ideas of his own. This study concludes that many scholars bore witness to the dialectical tension between reason and revelation; only some believed that a solution was possible. That being said, and despite the paradoxical nature of the dual truth approach (which maintains that two contradictory truths exist and we must live with both of them in this world until a utopian future or the advent of the Messiah), increasing numbers of thinkers today are accepting it. In doing so, they are eschewing delusional and apologetic views such as the identicality and compartmental approaches that maintain that tensions and contradictions are unacceptable. (shrink)

The Intellectualist thesis that know-how is a kind of propositional knowledge faces a simple problem: For any proposition p, it seems that one could know p without knowing how to do the activity in question. For example, it seems that one could know that w is a way to swim even if one didn't know how to swim oneself. In this paper I argue that this “sufficiency problem” cannot be adequately addressed by appealing to practical modes of presentation.

The complexity and flexibility of tagmemic theory, as a semiotic theory developed by Kenneth L. Pike, can be better understood by examining how it applies to a simple semiotic system like traffic lights. We can then compare the result with how it functions in analyzing a piece of natural language. Tagmemic theory introduces three observer viewpoints – the particle view, the wave view, and the field view. Each view generates a suite of questions to answer. Any one of the views (...) results in a “complete” description of traffic lights, from which the information about the other views can be inferred. And yet each view is distinct in texture from the others, and the existence of such multiple views – each with a claim to emic integrity and each serving as a perspective on the whole – has to be accounted for in a robust semiotic approach. The same phenomena occur when we apply the three views to the analysis of meaning in natural language. The chief illustration is to analyze the meaning of the word dog in multiple ways. The multi-dimensional potential for semiotic analysis highlights the limitations of Aristotelian logic and symbolic logic, both of which simplify for the sake of rigor. (shrink)

Anti-Intellectualists about know-how , following Ryle, hold that knowing how to do something is simply having the ability to do it. With qualifications, I defend this traditional view. The central motivation is drawn from observations about what is involved in learning to do something. Two sorts of ability are distinguished and the thesis is defended against putative counterexamples.

An account of the distinction between singular and general propositions should reflect the core ideas that have motivated the distinction. Those core ideas can be appreciated independently of many commitments regarding the metaphysics of propositions, but theorists with differing views on the latter have given quite different explanations of what it is for a proposition to be singular or general. Many of those explanations turn out not to reflect the core ideas adequately after all, either by misclassifying certain propositions or (...) by failing to be sufficiently informative. A more satisfactory account can be formulated by more directly elaborating on the background ideas motivating the distinction. The resulting account not only does better than its competitors, but is compatible with various views on the metaphysics of propositions. (shrink)

Research ethics committees are charged with providing an opinion on whether research proposals are ethical. These committees are overseen by a central office that acts for the Department of Health and hence the State. An advisory group has recently reported back to the Department of Health, recommending that it should deal with inconsistency in the decisions made by different RECs. This article questions the desirability and feasibility of questing for consistent ethical decisions.

This book explores three schools of fascinating, talented, and gifted scholars who absorbed into their thought the Jewish and secular cultures of their respective homelands. They include halakhists such as Rabbi Ettlinger and Rabbi Eliezer Berkowitz; Jewish philosophers from Isaac Bernays to Yeshayau Leibowitz; and biblical commentators such as Samuel David Luzzatto and Rabbi Umberto Cassuto. Running like a thread through the analysis of the different scholars, is the attempt to conciliate Jewish orthodoxy with a wish to connect with Western (...) culture and philosophy and to accept the conclusions of scientific research. Among these attempts is Luzzatto's famous "dual truth" approach. This book is the sequel to the Ephraim Chamiel's previous book The Middle Way, which focused on the challenges faced by the members of the "Middle Trend" in nineteenth-century Jewish thought. Honor is a difficult field of inquiry that deserves systematic attention from social scientists. Honor is an internalized concern for recognition and approval that links reputation with conduct and helps sustain existing patterns of social selection and evaluation. The paper argues that scholars are remiss that consider the field of honor obsolete or a residual category left over from the transition to modern forms of social organization. A modern conception of honor is identified in the relationship of a reflexive self (...) and a larger moral and institutional order. A further effort is made to elaborate a reflexive approach to honor informed by the intersection of Pierre Bourdieu's theory of social reproduction and Erving Goffman's theory of self presentation. Honor is theorized as a multi-dimensional field that legitimates prevailing standards of evaluation and social selection contested in staged and consecrated interactions that are central to social reproduction. This book provides an overview of computer techniques and tools — especially from artificial intelligence (AI) — for handling legal evidence, police intelligence, crime analysis or detection, and forensic testing, with a sustained discussion of methods for the modelling of reasoning and forming an opinion about the evidence, methods for the modelling of argumentation, and computational approaches to dealing with legal, or any, narratives. By the 2000s, the modelling of reasoning on legal evidence has emerged as a significant area within (...) the well-established field of AI & Law. An overview such as this one has never been attempted before. It offers a panoramic view of topics, techniques and tools. It is more than a survey, as topic after topic, the reader can get a closer view of approaches and techniques. One aim is to introduce practitioners of AI to the modelling legal evidence. Another aim is to introduce legal professionals, as well as the more technically oriented among law enforcement professionals, or researchers in police science, to information technology resources from which their own respective field stands to benefit. Computer scientists must not blunder into design choices resulting in tools objectionable for legal professionals, so it is important to be aware of ongoing controversies. A survey is provided of argumentation tools or methods for reasoning about the evidence. Another class of tools considered here is intended to assist in organisational aspects of managing of the evidence. Moreover, tools appropriate for crime detection, intelligence, and investigation include tools based on link analysis and data mining. Concepts and techniques are introduced, along with case studies. So are areas in the forensic sciences. Special chapters are devoted to VIRTOPSY (a procedure for legal medicine) and FLINTS (a tool for the police). The appearance of this Korean translation of Reality and Reason gives me the opportunity to clarify the purpose of the book and to indicate some of the areas in which my views have developed and altered in the years since it was first written. My primary aim in the book is to explain and defend the realist and materialist view that there is an objective material world of which we can have knowledge. My argument, I have now come to realise, (...) takes a Kantian `transcendental' form. I do not prove these propositions from any more fundamental or indubitable premises, for there are none. Rather, starting from the assumptions that there is a material world and that knowledge of it is possible, I try to show how such knowledge is possible Β what are its necessary conditions Β and what this entails about the nature of subject and object, appearance and reality, and the relations between them. Althusser and Ruben adopt a similar approach, I now see, and I regret my polemic against them on this topic (pp. 9-14). A great deal of traditional epistemology starts from the Cartesian assumption that we have immediate and indubitable knowledge of the contents of subjective consciousness, of appearances; whereas objective reality is something beyond and separate, and related to appearances only contingently. Once a dualistic gulf is created in this way between subject and object, knowledge of the objective world by the subject becomes inexplicable and impossible. The possibility of such knowledge obliges us to reject dualism and assume instead the unity of subject and object, appearance and reality. Reality must not be regarded as a mere `thing-initself' beyond or behind appearances, it is revealed in and through appearances. And appearances are not purely subjective: they are not mere appearances, but always and necessarily the appearances of some aspect of objective reality which is disclosed in and through them.. On the background of voluntary assurances made by corporations in line with the assertions in their corporate social responsibility disclosures, we investigate which types of firms will obtain an independent certification of their corporate social responsibility disclosures. The study is based on firms listed on the Johannesburg Stock Exchange (JSE) from 2015 to 2019. Deviating from traditional regression approaches, we employ machine learning techniques and show that machine learning techniques obtain superior performance compared to traditional logistic regression at predicting the (...) likelihood of corporate social responsibility assurance by a corporation. The result also shows that large firms with high CSR score, independent board, highly leveraged and belonging to finance industry are the most likely to assure their CSR disclosures. (shrink)

Andrew Sayer undertakes a fundamental critique of social science's difficulties in acknowledging that people's relation to the world is one of concern. As sentient beings, capable of flourishing and suffering, and particularly vulnerable to how others treat us, our view of the world is substantially evaluative. Yet modernist ways of thinking encourage the common but extraordinary belief that values are beyond reason, and merely subjective or matters of convention, with little or nothing to do with the kind of beings people (...) are, the quality of their social relations, their material circumstances or well-being. The author shows how social theory and philosophy need to change to reflect the complexity of everyday ethical concerns and the importance people attach to dignity. He argues for a robustly critical social science that explains and evaluates social life from the standpoint of human flourishing. (shrink)

Objectives: To compare non-treatment decision making by general practitioners and geriatricians in response to vignettes. To see whether the doctors’ decisions were informed by ethical or legal reasoning.Design: Qualitative study in which consultant geriatricians and general practitioners randomly selected from a list of local practitioners were interviewed. The doctors were asked whether patients described in five vignettes should be admitted to hospital for further care, and to give supporting reasons. They were asked with whom they would consult, who they believed (...) ought to make such decisions, and whether the relatives’ preferences would influence their decision making.Main measures: To analyse the factors influencing the doctors’ decisions not to admit otherwise terminally ill patients to hospital for life prolonging treatment.Results: Seventeen GPs and 18 geriatricians completed the interview. All vignettes produced strong concordance in decision making between both groups. Ten per cent of the doctors would provide life prolonging treatment to patients with severe brain damage. Most would admit a surgical patient regardless of age or disability. Medical reasons were largely used to explain decision making. The wishes of relatives were influential and resource considerations were not. There was variability regarding decision making responsibility.Conclusions: Little attempt was made to link decision making with ethical or legal concepts and there may have been non-recognition, or denial, of the ethical consequences of failure to admit. The process of decision making may involve deception. This may be conscious, because of the illegality of euthanasia, or unconscious , because of deepseated medical and societal reluctance to accept that intentionally withholding life prolonging treatment may equate with intentionally causing death.
